contacting design general website terms
1. Provision of Services
1.1 contacting design will provide to yourself the services and products outlined in your purchase order in accordance with these general terms and conditions. The two articles form the total agreement between us, and any variances to these must be agreed to in writing.
1.2 Written forms of communication include letters, formal documents, facsimiles or electronic mail.
2. Payments & Intellectual Property
2.1 Price quotations are only valid for a period of 30 days.
2.2 50% of the total invoice must be paid upon commencement of work to be carried out, with the outstanding amount payable before the finished project is delivered or posted online.
2.3 Payment may be made via cheque, direct deposit, cash, Visa or Mastercard.
2.4 Final payment will signify the completion of the project, unless otherwise noted in writing.
2.5 contacting design will control all intellectual property rights on work being carried out until the final payment is settled.
2.6 Files used in the creation of your site remain the property of contacting design.
2.7 contacting design retains the right to use material and artwork created in promotional material for contactingmedia.
2.8 contacting design retains the rights to any systems or techniques used in developing your project for any other use by contacting design, unless otherwise stated.
2.9 You will remain liable for all fees if our services have been discontinued or suspended due to failure on your part to comply with these general terms and conditions.
2.10 Client supplied property to contacting design will be held at the risk of the client, although all reasonable care will be taken to avoid damage or loss.
2.11 Upon final payment, copyright and ownership of the products delivered will reside with the client.
3. Confidentiality
contacting design will not disclose any information to third party regarding the client’s proprietary information that is commercial in confidence.
4. Suspension and Termination of Services
contacting design reserves the right to suspend or terminate services if payment is not received, including taking your website down from the internet.
5. Website Content
5.1 contacting design advises that it is your responsibility to fully proof read and test your website or project to ensure accuracy and compliance with your needs prior to the final payment.
5.2 contacting design will endeavour to remedy any errors made by staff of contacting design throughout the construction of your project.
5.3 You must ensure that material supplied to contacting design for use in your project does not infringe on the copyrights of any third party, and is compliant with all relevant Australian legislation.
5.4 You must ensure that material supplied to contacting design does not contain any material that is libelous, abusive or obscene in any manner.
5.5 contacting design reserves the right not to implement material that is either inappropriate or offensive.
5.6 contacting design will endeavour to test your website on several different website browsers, however contacting design cannot guarantee full cross-browser compatibility on some less popular browsers.
5.7 contacting design cannot guarantee compatibility with any future browser releases.
5.8 contacting design will make websites compliant with specific web browsers if specifically commissioned by the client through the purchase order or in writing.
6. Web Hosting and Domain Registration
6.1 All initial purchase orders for websites include a one year registration of your domain and all website hosting.
6.2 An annual renewal fee is payable prior to the expiry of each year, refer to our current rate card.
6.3 There are no monthly fees.
6.4 Failure to pay your annual fee on time may result in you losing the rights to your domain name.
6.5 If you are supplying your own hosting after the initial one year period, contacting design cannot guarantee the compatibility of your website on any other server.
6.6 contacting design utilised the services of industry leading web hosting internet service providers, however we cannot guarantee that there will be 100% server uptime.
7. Website Maintenance
7.1 Unless otherwise stated in your purchase order, any ongoing maintenance, changes or additions to your project will attract a fee, see our current rate card.
7.2 The hourly rate will be charged at a minimum of one hour increments.
7.3 Ongoing maintenance agreements can be drawn up by contacting design to assist in the ongoing development of your project.
8. Website Alterations
8.1 contacting design does not take any responsibility for any alternations or modifications made to your website by either yourself or a third party.
8.2 Any work carried out by contacting design to remedy problems arising from outside alterations will be charged at the current maintenance hourly rate.
8.3 Any release of FTP or login information to the client will be the responsibility of the client.
9. Search Engine Positioning
9.1 Specific positions in search engine result listings are not guaranteed by contacting design. contacting design will endeavour to implement best practices with regards to search engine optimisation, however this may not ensure any specified position within search engine rankings.
9.2 Unless otherwise stated in the purchase order, it is the responsibility of the client to undertake external link exchanges or similar to assist with their search engine optimisation works.
9.3 Strategies such as updating site content to ensure re-indexing by search engines is the responsibility of the client.
10. Supply of information
10.1 Unless otherwise stated in the purchase order, all material must be supplied to contacting design.
10.2 Material may take on a suitable electronic or hard copy format, please enquire with contacting design to ensure the usability of your material.

- Initial consultation
- Project specification sheet filled out providing scope of project
- Quote provided, including purchase order details
- Required to be signed and returned, invoice raised, 50% payment required.
- Concept developed, proofs provided, basic design and layout signed off.
- Project further developed, 50% final payment made to signify completion of project.
Current Rate Card as at 26th January 2008
1. Yearly domain name and hosting fee- $75 inc GST
2. Yearly hosting fee (you control your own domain)- $50 inc GST
3. Maintenance hourly work charge- $85 inc GST
4. Additional pages to those supplied with your package- $100 inc GST per page.
5. Additional email addresses- $50 inc GST each.
6. Additional Google Map markers- $35 inc GST each.
